Can Pawnbrokers Buy and Sell Guns?

You most likely see pawn shops across the country that state they “buy and sell guns”, but is this truly allowed? Thankfully, it is allowed, but it comes with a strict set of rules and regulations that must be followed. No matter how you view firearms, it’s crucial that all federal laws are followed correctly or there will be severe consequences for the pawn shop. Below, you’ll find the rules and regulations that must be followed.

 

What is a Federal Firearms License?

In 1968, the Gun Control Act has legally required that a federal firearms license be needed in order to sell firearms and/or ammunition. This license is the bare minimum needed, whether you’re importing or exporting them, conducting interstate sales, or conducting intrastate sales.

There are different types of firearm licenses available depending on the type of dealing you do. Being a pawnbroker, you’ll need a Type 2 License.

To obtain this license, you need to have the following:

  • Minimum of 21 years old
  • No suspensions or bans from shipping, receiving, transporting, or processing firearms and ammunition
  • Not on the “prohibited persons” list provided by the ATF
  • No false claims have been made regarding the application of firearms
  • Own a physical business location

In addition to the requirements mentioned above, you’ll also need to confirm that:

  • Your business and license are not in violation of any local, state, or federal laws
  • You comply with all conduct requirements of the state within 30 days of receiving your license
  • No transactions are made until your business matches all local and state requirements
  • You have notified the chief law enforcement official that you are applying for the license
  • All firearms are safely stored/displayed at the place of sale

If you match all of the requirements listed above, then you should be able to obtain a license with no trouble. We also recommend that you complete an FFL-certified online course for additional assistance and understanding. 

After your application has been approved, you’ll have an in-person meeting with your Industry Operations Investigator to ensure your business matches all regulations and is a legitimate business. Once this interview is complete, you’ll receive your license in 30 to 60 days, if the meeting goes well.
